US Federal Judge Rules Bankruptcy Won’t Get Johnson & Johnson Off the Hook with New Talc Lawsuits

Although Johnson & Johnson’s (J&J) recent bankruptcy filing was a success, worries aren’t over for the company as they prepare for a new class-action lawsuit involving talc products. The bankruptcy was part of the settlement of a recent class-action lawsuit filed against the company by patients affected by talc products. However, on Tuesday, a federal judge ruled that the successful filing will not affect an upcoming class-action lawsuit filed by the company’s employees.

According to Nicole DeFeudis of Endpoints News, “The new complaint will be filed in New Jersey Superior Court by the family of Louis Edley, a former worker who claimed he was exposed to asbestos while working with the industrial talc made by J&J’s former subsidiary Windsor Minerals. After falling ill with the chronic lung disease asbestosis, Edley brought a personal injury suit against Windsor, to which J&J’s lawyers responded that no evidence of asbestos in its products “has ever been revealed” by testing. Edley ended up tossing the case — but by the end of 1989, more than 1,000 talc cases had been brought against J&J alleging Windsor’s industrial talc caused asbestos-related disease in workers, according to court documents.”
