As Cigna looks to wrap up its deal with Express Scripts, a lawsuit claiming the insurer overcharged members using artificially inflated drug costs can move forward.
A federal judge in Connecticut this week ruled most of the claims against Cigna could move forward, Fierce Healthcare reports.
The complaint, which was filed by several members in 2016, alleges the insurance company violated both the Employee Retirement Income Security Act and Racketeer Influence and Corrupt Organizations Act.
U.S. District Court Judge Warren Eginton says the complaint levied against Cigna plausibly alleges it “intentionally sought to charge excess amounts for prescription drugs and that it required the pharmacies to conceal from the insureds the amounts of the prescription drug costs.”
