Biden’s LGBTQ Healthcare Anti-Discrimination Proposal Mired in Legal Challenges

An anti-discrimination rule proposed by the Biden administration to protect LGBTQ people is already facing legal challenges. The rule, an expansion of a previous Health and Human Services policy, would prevent federally-funded health programs from discriminating based on sexual orientation or gender identity. Several organizations representing religiously affiliated healthcare systems have filed lawsuits despite the rule not being made official until April.

According to Lydia Wheeler of Bloomberg Law, “The proposed rule the Centers for Medicare and Medicaid Services (CMS) released on Dec. 30 bans qualified health insurance plans offered on the state and federal exchanges from discriminating against gay and transgender people.”
