Axios obtained a 36-page contract template used by pharmacy benefit manager Express Scripts from an unidentified source in the health care industry, and has offered some insight into what such a template entails.
One of the major takeaways from the template, according to Axios, is the language inside which puts the PBM’s financial interests above all else.
” … Critics say those kinds of provisions can result in lost savings for everyone, especially for small companies and their employees,” Axios reporter Bob Herman.
Even larger companies, who may feel less prone to detrimental agreements, could be negatively impacted by the contracts.
“That’s a little bit like going to Las Vegas and consistently thinking you can beat the house at their own game,” an unidentified source with experience in the industry told Axios. “These PBMs have entire departments of lawyers where this is their game.”
