Affordable Care Act Hinges Upon Today’s Supreme Court Arguments

Today the Supreme Court will hear oral arguments in California v. Texas. Nearly every corner of the healthcare industry, including the nation’s four leading hospital associations, the insurance lobby, and the generic drug lobby, supports the law. However, if the court deems the law unconstitutional, the ACA could be struck down in its entirety. The only healthcare group that has voiced support for overturning the ACA was the Association of American Physicians and Surgeons, a small conservative physician group. PhRMA was noticeably absent from the debate but did offer the following statement:

“Since the enactment of the Affordable Care Act there has been wide recognition that despite providing better access to coverage and closing the Medicare Part D coverage gap for seniors, the law is not perfect.  But maintaining steady and predictable access to insurance is key to winning the fight against COVID-19, and great caution is needed to avoid disruptions in care and protect vulnerable patients,” the spokesperson wrote.
