HHS Defends Rule on Drug Prices in TV Ads

January 13, 2020

The Department of Health and Human Services (HHS) was in court Monday defending its rule requiring drugmakers to include a drug’s list price in TV ads, MM&M reports.

According to the report, HHS attorney Ethan Davis argued the rule would ultimately boost competition and drive down prices.

Davis also doubled down on the claim that the Centers for Medicare and Medicaid Services has the “authority to publish rules and regulations that may be necessary to the efficient running of Medicaid and Medicare.”
