U.S. Health and Human Services Secretary Alex Azar and Centers for Medicare and Medicaid Services officials are poised to turn down Massachusetts’ bid to use closed formularies for cheaper brand drug prices in Medicaid, InsideHealthPolicy reports.
Azar, according to an unidentified source, is concerned drug manufacturers would successfully litigate the U.S. if the waiver for the closed formularies were approved.
Some say CMS officials want to avoid creating a precedent through a de facto policy due to the liklihood of other states following Massachusetts.
